Terms and Conditions

The products and information contained herein have been developed by Maxton Manufacturing Company. They are subject to change and are intended for use by professionals trained in the manufacture, installation, and maintenance of hydraulic elevator systems. While this information is deemed reliable, Maxton disclaims any liability arising from misinterpretation.

Limited Warranty

All control and safety valves sold by Maxton are warranted only to purchasers for resale or for use in business or original equipment manufacturer against defects in workmanship or materials under normal use for two (2) years from date of purchase. Any part which is determined by Maxton to be defective in material or workmanship and returned to Maxton, shipping costs prepaid, as exclusive remedy, will be repaired or replaced at Maxton’s option. This warranty cannot be transferred or assigned to third parties. All warranties are considered null and void upon transfer unless the intent to transfer to a third party is expressly indicated in a purchase order or the customer is a known OEM and a user of Maxton’s products. Any alteration or removal of designated serial numbers will cause the warranty to be immediately null and void.

Warranty Disclaimer

Maxton has made diligent effort to provide illustrations, descriptions, and technical information for the proper use of its products. In addition, we are glad to offer suggestions and technical support for the use of our various products. Nevertheless, there are no warranties given except such expressed warranties offered in connection with the sale of a particular product as stated in the Limited Warranty above. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE GIVEN IN CONNECTION WITH THE SALE OF ANY GOODS. In no event shall MAXTON MANUFACTURING COMPANY be liable for consequential, incidental, or special damages. The sole and exclusive remedy and the limit of Maxton’s liability for any loss whatsoever, shall not exceed the purchase price paid by the purchaser for the product to which the claim is made.

Product Suitability

Many states and localities have codes and regulations governing sales, construction, installation and/or use of products, which may vary from those in neighboring areas. While Maxton attempts to assure that its products comply with such codes, it cannot guarantee compliance, and cannot be responsible for how the product is installed or used. Before purchase and use of a product, please review the application, and national and local codes and regulations and be sure that the product, installation, and use comply with them.

Return/Repair Inquiries

Please direct all in- and out-of-warranty repairs to Maxton’s Repair Dept. Before returning any product, please contact the sales/service department by phone, fax or online to obtain a return authorization number (RA #), a form is available online with an automatically generated a RA#. The designated RA # should then be marked on the outside of the package. To avoid processing delays, be sure to include the following: Purchase order number and RA #, Returnee’s name, address and phone number, Model number and serial number, and repair instructions and description of problem. All pipes, coils and covers must be removed prior to shipping. Maxton will not be responsible for lost or damaged pipes, coils or covers. Any pipes removed by Maxton will be subject to additional charges. Any valves received with missing flanges will be subject to additional charges. All products must be returned freight prepaid. Returnee when applicable must pay brokerage fees, taxes and duties. New product returned is subject to a 20% restocking fee, plus the original freight charge.

Modification And / Or Unauthorized Repairs

In the event of modification and/or repair of Maxton’s product(s) by unauthorized repair facilities, you will indemnify us and hold us harmless from any liability or damage whatsoever arising out of the subsequent use of the product(s). Any use of unauthorized repair facilities voids all warranty claims.

General Sales Information

Shipments

Orders for shipments received after 1:00 pm Pacific Standard Time will be processed the following day. Shipments will be insured on request only.

Returns

Please call, fax, e-mail or use our online form for a return authorization number (RA#) before returning any goods. A 20% restocking charge will be assessed for all goods returned in new condition however, you must contact the Sales Department for approval for credit consideration before returning any items, as there is a time limit.

Charge Back Fee

When shipping collect / 3rd Party…if shipping charges, duties and taxes are billed back to Maxton, due to customer account issues, $50.00 fee will be added to the resolution amount.

Billing

We accept MasterCard, Visa, American Express, and Discover Credit Cards. Wire Transfers and ACHs are also accepted forms of payment. We may accept checks and extend Net 30 terms after completion of our credit application. F.O.B. Minden, Nevada. Minimum billing is $50.00.

Payment Methods

If you have an existing account in good standing with Maxton, you may submit an online purchase order, to be invoiced according to our established terms. If you wish to establish credit with Maxton, please complete and submit our Credit Application.

Credit cards are no longer accepted online. If you wish to pay via credit card instead of submitting a purchase order, payments may be made with one of the 4 major bank credit/debit cards by calling Maxton at 775-782-1700 or faxing 775-782-1701

Credit Card Transaction Policy

Upon submission Maxton will charge the credit card account for the full order amount at the time of shipment. All orders, regardless of origin or payment method, are payable in U.S. dollars. Any invoices paid with a credit card after the time of purchase/shipment will incur a 3% non-refundable convenience fee.
